This is an agreement between the user "USER" and the FMS Foundation "PROVIDER" concerning the use of Mendel's Accountant "MENDEL". 1. WE CAN SUSPEND OR TERMINATE YOUR ACCOUNT AT ANY TIME FOR ANY REASON WITHOUT WRITTEN CONSENT. If we suspect any foul play, or the user is using MENDEL in a way that is unethical or is not in the best interest of the provider, we can suspend your account for any reason. 2. DISCLAIMER OF WARRANTIES. If anything happens to the USER's computer or property during the use of MENDEL, the PROVIDER will not be held liable. 3. LIMITATION OF LIABILITIES. The provider will not be responsible for any loss of MENDEL data on the server. Therefore, it is recommended that the USER back up simulation data to their own computer. 4. SIMULATION RESULTS: a. USE MENDEL'S ACCOUNTANT AT YOUR OWN RISK. While we have made every effort to ensure that MENDEL is the most-advanced, most accurate simulation of mutation dynamics, the PROVIDER will not be held responsible how the simulation results will be used. b. The RESULTS of any MENDEL simulations must make reference to MENDELs website, or reference to the following journal article: J. Sanford, J. Baumgardner, W. Brewer, P. Gibson, and W. Remine.
